Terms and conditions

These terms and conditions apply to any booking made on TopHote. They set out the rules governing booking, payment, cancellation, withdrawal, and liability for the reserved stay.

Purpose and scope

TopHote acts as a booking and payment intermediary for the stays offered on the website. The contract concluded with the guest covers the booking of the selected property for the chosen dates and under the conditions displayed at checkout.

The information shown before final validation forms part of the contract for the specific booking concerned.

Booking

A booking is confirmed once the guest has provided the required information, accepted these terms and conditions, and completed payment using the booking flow. A booking is not final until those steps have been completed.

The guest agrees to provide accurate and up-to-date information. TopHote may request reasonable supporting documents where identity, payment, or compliance checks are necessary.

Prices and fees

Prices displayed on the website are shown in euros and include applicable taxes unless expressly stated otherwise. Any additional fees, discounts, local taxes, or security deposits are shown before final validation where applicable.

In the event of a manifest pricing error, TopHote may correct the price before the booking is finally confirmed. The guest will be informed before any additional charge is made.

Payment terms

Payments are processed securely through our payment provider. The amount charged corresponds to the total shown at checkout, except for an explicit correction due to a manifest error or an agreed adjustment with the guest.

Payment may be required in full at booking time or according to the schedule displayed in the stay offer. Any special conditions displayed for a specific offer take precedence over these terms for the booking concerned.

Cancellation policy

The applicable cancellation policy is the one displayed at booking time and reminded before payment. It may vary depending on the property, the stay period, or any promotional offer in force.

Where a specific condition is stated in the offer or booking summary, that condition prevails for the booking concerned.

Unless a different specific condition applies, cancellations must be notified in writing. Any fees, discounts, or refunds are determined by the conditions shown before final validation. No refund is due for services already provided or rendered non-recoverable under the conditions accepted by the guest.

Right of withdrawal

Under Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services that must be provided on a specific date or during a specific period.

By confirming a booking, the guest acknowledges that the accommodation service is tied to a specific date and falls within that legal exception.

Guest obligations

The guest agrees to use the property with care, follow the stay rules communicated before arrival, and avoid any nuisance to neighbors. The guest is responsible for any damage caused by themselves, their companions, or anyone they allow into the property.

The guest should also ensure that their liability insurance covers any damage they may cause during the stay.

TopHote responsibilities

TopHote strives to keep published information current and accurate, but cannot guarantee the absence of typographical errors or unintended omissions. TopHote shall not be liable for any failure caused by the guest, a third party, the property owner, or force majeure.

If the reserved property becomes exceptionally unavailable, TopHote will use reasonable efforts to offer an alternative solution or a refund depending on the applicable situation.

Legal guarantees

Under Articles L217-1 et seq. of the French Consumer Code, TopHote is bound by a statutory guarantee of conformity for the services offered. Under Articles 1641 et seq. of the French Civil Code, the guest also benefits from the statutory guarantee against hidden defects. These guarantees apply regardless of any commercial guarantee that may be offered.

Personal data collected during the booking process is handled in accordance with our privacy policy, available on the website.

Claims and governing law

If the guest has a question or a claim, they may contact TopHote using the contact address published on the website. If a dispute cannot be resolved amicably, the European Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr

These terms and conditions are governed by French law.
